WTO Menangkan Gugatan Amerika dan Selandia Baru atas Pembatasan Impor Pertanian Indonesia

Organisasi Perdagangan Dunia mengabulkan gugatan Amerika Serikat atas Indonesia. Batasan impor produk agrikultur yang diterapkan Indonesia buat melindungi petani lokal dinilai melanggar perjanjian dagang internasional.

Organisasi Perdagangan Dunia (WTO) mengabulkan gugatan Selandia Baru dan Amerika Serikat terhadap Indonesia ihwal regulasi impor produk pertanian. Kedua negara menuding Jakarta melanggar aturan dagang internasional, dengan memberlakukan pembatasan impor terhadap berbagai produk agrikultur seperti buah-buahan, sayur-sayuran, daging sapi dan ayam.

Dewan penyelesaian sengketa WTO memutuskan 18 aturan pembatasan impor yang diberlakukan Indonesia "tidak konsisten" dengan Perjanjian Umum 1994 tentang cukai dan perdagangan (GATT 1994). Organisasi yang mengawasi aktivitas perdagangan di 164 negara anggotanya itu mendesak Indonesia "untuk mengambil langkah yang sesuai dengan GATT 1994."

Sejak 2012 pemerintah Indonesia membatasi impor dan penjualan daging sapi dan ayam impor. Daging sapi impor misalnya cuma diizinkan dijual di hotel dan restoran, tapi tidak di supermarket atau pasar tradisional. Sementara pihak yang mengimpor buah dan sayur impor harus memiliki ruang penyimpanan ber-AC di lokasi penjualan.

Perwakilan dagang AS, Michael Froman menyebut putusan itu sebagai "kemenangan besar." Menurut dia pemerintahan Obama sekali lagi telah bertindak demi kepentingan petani. peternak dan penguasaha Amerika. "Putusan ini menghapus pembatasan impor yang tidak adil terhadap produk agrikultur Amerika", tambah Froman.

Sementara Menteri Pertanian AS, Tom Vilsack, menyebut regulasi pemerintah Indonesia "menghalangi produsen AS untuk menjual produknya di pasar Indonesia, mulai dari kentang, daging sapi, anggur, jeruk dan daging ayam." Menurutnya putusan WTO akan membuat pemerintah Indonesia jera dan mengembalikan daya saing petani dan peternak Amerika."

Indonesia akan Mengajukan Banding

Pemerintah Indonesia akan mengajukan permohonan banding atas putusan Organisasi Perdagangan Dunia (World Trade Organization/WTO) yang memenangkan gugatan Amerika Serikat dan Selandia Baru.

“Kita akan ajukan banding karena ada beberapa peraturan yang disengketakan Amerika Serikat dan Selandia Baru sudah diamendemen selama proses sengketa berlangsung,” ujar Direktur Jenderal Perundingan Perdagangan Internasional Kementerian Perdagangan Iman Pambagyo kepada Tempo, Senin, 26 Desember 2016. Iman menambahkan, ada beberapa peraturan lain yang disengketakan oleh dua negara itu masih bisa disesuaikan dengan memperhatikan kesejahteraan petani di Indonesia.

Gugatan Amerika Serikat dan Selandia Baru diajukan pada masa pemerintahan Presiden Susilo Bambang Yudhoyono. Pemerintah menganggap hasil putusan WTO sudah kedaluwarsa karena kebijakan pengetatan pertanian dilakukan pemerintah pada 2011 atau pada masa Presiden SBY. Selain itu, saat ini pemerintah sudah melakukan berbagai langkah deregulasi di berbagai sektor.

The WTO ruled in favour of US and NZ against agriculture import restriction on Indonesia

US - United States Trade Representative Michael Froman announced shortly before Christmas that a World Trade Organisation (WTO) dispute settlement panel has found in favour of the United States’ challenge to Indonesia’s wide-ranging restrictions and prohibitions on horticultural products, animals, and animal products.

The United States, working closely with New Zealand as co-complainant, filed this dispute to address trade barriers in Indonesia that restrict the importation of American fruits and vegetables (such as apples, grapes, and potatoes), animal products (such as beef and poultry), and other agricultural products.

The WTO Panel agreed with the United States on 18 out of 18 claims that Indonesia is applying import restrictions and prohibitions that are inconsistent with WTO rules.

“The Obama Administration has again prevailed on behalf of US farmers, ranchers, and businesses,” said Ambassador Froman.

“Today’s panel report will help eliminate unjustified trade restrictions on American agricultural products, allowing US farmers and ranchers to sell their high-quality products to customers in Indonesia – the fourth-most populous country in the world.”

“This is a slam dunk for American agriculture,” said Agriculture Secretary Tom Vilsack. “Since 2012, Indonesia has maintained an untenable import licensing program, harming the ability of U.S. producers to sell a wide range of American-grown products in the Indonesian market – from potatoes to beef to grapes to oranges to poultry. Importantly, the WTO Panel findings will discourage Indonesia from simply substituting new trade-distorting approaches for the measures repealed, restoring American farmers' and ranchers' ability to compete.”

Indonesia to File Appeal upon WTO Ruling

The Indonesian government will file an appeal of the World Trade Organization’s (WTO) court ruling on the winning of the United State and New Zealand’s legal suit.

"We’ll file an appeal since several regulations being sued by the US and New Zealand had been amended during the legal process," said the Director of International Trade Cooperation at the Trade Ministry Iman Pambagyo to Tempo Monday, December 26, 2016.

His party also said that several regulations being sued by the two countries could still be adjusted by considering the welfare of Indonesian farmers, Iman added.

The US and New Zealand’s complaints submitted during the administration of President Susilo Bambang Yudhoyono (SBY). The government argued that the WTO’s judgment was expired since the policy was effective back in 2011 or during SBY administration while the government has now applied deregulations in various sectors.
